1. Scope
Any delivery, service and offer shall be provided exclusively based on these Terms of Payment and Delivery.
These Terms shall be deemed accepted upon receipt of the goods or services at the latest. Deviations from these Terms shall be effective only if confirmed in writing by the Seller.
2. Prices
The Prices are ex works, exclusive of packing, uninsured, as a rule.
All Prices are subject to confirmation and are understood including legal VAT.
3. Shipping
Deliveries are made according to the Seller's choice by forwarding agent or postal service.
The Seller may make partial deliveries and provide partial services.
4.Reservation of Ownership
The Goods shall remain the Seller's property until paid in full.
The Buyer is not entitled to re-sell the goods to third persons without the Seller's consent.
5. Warranty
We shall grant the usual warranty for defects, if any, provided that the defect will be reported within 10 days upon delivery.
Defects which cannot be detected within this time even with careful inspection shall be reported in writing to the Seller immediately after they have been detected.
The right for subsequent performance shall become void if the Buyer has carried out repairs himself or used non-original spare parts.
The warranty shall not include galvanic finishes and wearing parts. Defects do not discharge the Buyer from his duty to pay. The Seller shall repair the defective part or supply a replacement part if the claim is justified and the defect has been notified in due time.
6. Payment
All invoices shall be due for payment immediately upon receipt without any deduction unless other terms of payment have been specified on the invoice.
Payments shall be made free of charges. We will apply a surcharge of 5.00 € for small quantities with an invoiced value of goods below 50.00 €.
Invoices for repairs up to 250.00 € shall become due for payment immediately (upon handing over to the customer).
7. Consignments on Approval/Sample Consignments
Consignments on approval/sample consignments must be returned in perfect condition, properly packed and free of charge if they are not purchased.
We will charge 25.00 € flat in such a case.
8. Scope of Law
These Terms of Payment and Delivery and all legal relations between the Buyer and the Seller shall be subject to the applicable law.
The place of performance shall be Markneukirchen / Vogtland and the legal venue shall be Auerbach. |
